Human Rights in Libya: National Council for Civil Liberties and Human Rights (NCCLHR) first International Human Rights Conference, Tripoli, 19 January 2014

The Libyan National Council for Civil Liberties and Human Rights (NCCLHR) will be holding their first International Human Rights conference in Libya since the fall of the former regime in 2011, on Sunday 19 January 2014. This is to be attended by representatives of the Libyan General National Congress (GNC), international human rights organisations, foreign State representatives, representatives from the European Union and the United Nations and international commercial entities.

NCCLHR LogoAs the independent Libyan human rights organisation established by law in 2011, the event will be a key developmental step in the continuing establishment of internationally recognised human rights safeguard mechanisms, protections and recourse to potential remedies stemming from reported human rights abuses as against the citizens of Libya.

The NCCLHR will be presenting their second official report and their three year Strategic Plan as drafted by the Danish Institute for Human Rights, with oversight from 9 Bedford Row International’s (9BRi) David Hammond.

Of key importance within the conference agenda, will be the introduction by the NCCLHR, of their intent to undertake the independent oversight role for human rights in business following the UN Guiding Principles for Human Rights in Business, otherwise known as the Protect, Respect and Remedy Framework. This work was led by the former UN Special Representative to the Secretary General for human rights in business, Professor John Ruggie as between 2005-2011, as part of a UN mandate.

The NCCLHR will be signing a non-legally binding “Declaration of Adoption” of the UN Guiding Principles for the first time and as the first human rights body in Libya to do so. The Declaration was jointly drafted by David Hammond and NCCLHR lawyers. It follows the direction and intent stated within the NCCLHR Strategic Plan, to expand roles in business and sets the conditions for future development in this field of human rights protections and remedies.

The conference will also discuss supporting international work from the American Bar Association (ABA), the International Legal Assistance Consortium (ILAC) and 9 Bedford Row International who lead the new “NCCLHR Partner Project” for human right in business training and development alongside partners which include Mazars LLP and AKTIS Strategy Ltd.

حقوق الإنسان في ليبيا: المؤتمر الدولي الأول لحقوق الإنسان بتنظيم المجلس الوطني للحريات العامة وحقوق الإنسان، في طرابلس، في 19 كانون الثاني/يناير 2014.

سوف يعقد المجلس الوطني الليبي للحريات العامة وحقوق الإنسان المؤتمر الدولي الأول لحقوق الإنسان في ليبيا منذ سقوط النظام السابق في العام 2011، وذلك يوم السبت 19 كانون الثاني/يناير 2014. وسوف يحضر المؤتمر ممثّلون عن المؤتمر الوطني العام الليبي، ومنظمات دولية تعنى بحقوق الإنسان، وممثلون عن الشؤون الخارجية، وممثلون عن الاتحاد الأوروبي والأمم المتحدة والهيئات التجارية الدولية.

ويشكل الحدث، بصفته المنظمة الليبية المستقلة التي تُعنى بحقوق الإنسان التي أنشأها القانون في العام 2011، خطوةً أساسية في عملية الإنشاء المستمرة لآليات معترف بها دوليًّا لضمان حقوق الإنسان، والحماية واللجوء إلى تعويضات محتملة تنشأ من انتهاكات حقوق الإنسان المبلَّغ عنها بحقّ مواطني ليبيا.

سوف يعرض المجلس الوطني للحريات العامة وحقوق الإنسان تقريره الرسمي الثاني والخطة الاستراتيجية لثلاث سنوات كما وضعها المعهد الدانماركي لحقوق الإنسان، بإشراف دايفيد هاموند من 9 بدفورد راو إنترناشونال 9 Bedford Row International’s (9BRi).

ومن البنود الهامّة ضمن جدول أعمال المؤتمر اعتماد المجلس الوطني للحريات العامة وحقوق الإنسان نيّته القيام بدور رقابي مستقلّ لحقوق الإنسان في الأعمال التجارية على أساس المبادئ التوجيهية للأمم المتحدة بشأن حقوق الإنسان في الأعمال التجارية، المعروفة بإطار “حماية، احترام، انتصاف”. وتولّى قيادةَ هذا العمل الممثلُ الخاص لأمين عام الأمم المتحدة لحقوق الإنسان في الأعمال التجارية، البروفسور جون راغي للفترة 2005-2011، كجزء من مهامّ الأمم المتحدة.

سوف يوقّع المجلس الوطني للحريات العامة وحقوق الإنسان على “إعلان اعتماد” غير ملزِم قانونًا للمبادئ التوجيهية للأمم المتحدة للمرة الأولى وكهيئة أولى من الهيئات التي تعنى بحقوق الإنسان في ليبيا التي تقوم بهكذا خطوة. وتمّت صياغة الإعلان بشكل مشترك بين دايفيد هاموند ومحامي المجلس الوطني للحريات العامة وحقوق الإنسان. وهو يتبع التوجيه والنوايا المنصوص عليها في الخطة الاستراتيجية للمجلس الوطني للحريات العامة وحقوق الإنسان، لتوسيع الأدوار في الأعمال التجارية والشروط للتنمية المستقبلية في هذا المجال من حماية حقوق الإنسان والتعويض عن الانتهاكات.

كما سيناقش المؤتمر أيضًا مسألة دعم العمل الدولي من جانب نقابة المحامين الأميركية، وكونسورتيوم المساعدة القانونية الدولية، و9 بدفورد راو إنترناشونال التي تقود “مشروع المجلس الوطني للحريات العامة وحقوق الإنسان للشركاء” الجديد بشأن التدريب على حقوق الإنسان في الأعمال التجارية والتنمية إلى جانب شركاء منهم مازارز أل أل بي Mazars LLP وأكتيس استراتيجي لمتد AKTIS Strategy Ltd.
